Rubbish Clearance Ilford Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Clearance Ilford provides rubbish clearance and waste collection services. By making a booking or using our services, you agree to be bound by these terms. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following definitions apply:

1.1 "Company", "we", "us" and "our" refer to Rubbish Clearance Ilford, the provider of rubbish clearance and waste collection services.

1.2 "Customer", "you" and "your" refer to any individual, business, landlord, agent or organisation that requests or uses our services.

1.3 "Services" refers to any rubbish clearance, waste removal, house clearance, garden waste removal, commercial waste collection, or related services we agree to provide.

1.4 "Waste" refers to any items, materials, rubbish, junk or refuse that you ask us to remove, subject to exclusions in these terms and under applicable law.

1.5 "Booking" refers to a confirmed request for services made by you and accepted by us.

2. Scope of Services

2.1 We provide rubbish clearance and waste collection services for domestic and commercial customers within our operating area. Our services typically include loading, transportation and lawful disposal or recycling of waste.

2.2 We reserve the right to refuse removal of any items that we reasonably believe to be hazardous, illegal, improperly packaged, excessively heavy, or otherwise unsuitable for collection.

2.3 We may photograph or record loads before and after clearance for evidence of service delivery, compliance, and health and safety purposes.

3. Booking Process

3.1 You may request a booking by telephone, email or online enquiry. All bookings are subject to availability and our acceptance.

3.2 When making a booking you must provide accurate information, including:

a. The full address where the clearance or collection is to take place.

b. A description of the waste, including the type, estimated volume or weight, and any special handling requirements.

c. Details of access, parking arrangements and any restrictions or time limits that may affect the service.

3.3 We may provide a price estimate based on the information you supply. This estimate is not binding and may be revised if, on arrival, we find that the waste quantity, type or access conditions differ from those described.

3.4 A booking is only confirmed when we have agreed a date and time window with you and, where required, you have paid any deposit or call-out fee requested.

3.5 You must ensure that an authorised person is present at the property at the agreed time to grant access, approve the items to be removed, and make or confirm payment arrangements.

4. Access, Parking and Preparation

4.1 You must ensure that we have safe, reasonable and legal access to the collection site. This includes providing accurate information about any access limitations such as gates, codes, height restrictions, steps or narrow passages.

4.2 You are responsible for arranging any permits required for parking or loading. Any parking charges, fines or penalties incurred due to insufficient or incorrect arrangements may be added to your invoice.

4.3 You should separate waste intended for collection from items to be retained. We will not be liable for removing items that were not clearly identified or that were mixed with waste scheduled for removal.

4.4 If the site is not ready for clearance at the agreed time, or if access is delayed by you, we may charge waiting time or, in some cases, a missed appointment fee.

5. Pricing and Quotations

5.1 Our charges are generally based on a combination of factors including volume, weight, type of waste, labour time, access conditions and disposal or recycling costs.

5.2 Any quotation or estimate provided before arrival is based on the information supplied by you and may be adjusted once we have inspected the waste in person.

5.3 If, on arrival, the actual load or work required is significantly different from that described at the time of booking, we will inform you of any revised price before proceeding. If you choose not to proceed, we may charge a call-out or attendance fee.

5.4 Additional charges may apply for heavy, difficult, or hazardous items, or for collections outside normal working hours, subject to prior agreement.

6. Payments and Invoicing

6.1 Unless otherwise agreed in writing, payment is due in full on completion of the service and prior to our vehicle leaving the site.

6.2 We accept standard UK payment methods as advised at the time of booking. We may require payment by card, bank transfer or cash, subject to operational requirements.

6.3 For business customers with agreed credit terms, invoices must be paid within the period stated on the invoice. Failure to pay on time may result in late payment charges and suspension of further services.

6.4 All prices are stated exclusive of VAT unless expressly stated otherwise. Where applicable, VAT will be charged at the prevailing rate.

6.5 If any payment is reversed, returned or refused by your bank or card issuer, you remain liable for the original amount and any associated charges.

7. Cancellations and Amendments

7.1 You may cancel or reschedule your booking by contacting us directly. We request as much notice as possible so that we can reallocate resources.

7.2 Cancellations or rescheduling made more than 24 hours before the agreed arrival window will usually be free of charge unless otherwise specified in your booking confirmation.

7.3 If you cancel or reschedule within 24 hours of the agreed arrival time, we reserve the right to charge a late cancellation fee or retain all or part of any deposit paid.

7.4 If we arrive at the site and are unable to complete the service due to incorrect information, lack of access, or your failure to be present, we may charge a missed appointment fee and any associated costs.

7.5 We may need to cancel or amend a booking due to vehicle breakdown, staff illness, severe weather, safety concerns or other circumstances beyond our reasonable control. In such cases we will make reasonable efforts to notify you and offer an alternative date or time. We will not be liable for any resulting loss or inconvenience.

8. Customer Responsibilities

8.1 You confirm that you are the owner of the items to be removed, or that you have the full authority of the owner to arrange their removal.

8.2 You must ensure that any waste handed over to us does not include prohibited items such as certain hazardous materials, clinical waste, asbestos, or any substances that we are not licensed or equipped to handle.

8.3 You must notify us in advance of any items that require special handling due to their nature, size, weight or potential risk.

8.4 Where practical, you should remove personal or confidential items from waste intended for collection. We are not responsible for any loss of personal documents, data or valuables that were left within items designated for removal.

9. Waste Regulations and Duty of Care

9.1 We operate in compliance with applicable UK waste management and environmental regulations. Where required, we hold appropriate licences and registrations for the carrying and disposal of controlled waste.

9.2 We will dispose of or recycle waste collected from you at authorised facilities in accordance with legal requirements and good environmental practice.

9.3 We may provide a waste transfer note or other documentation where legally required or where requested by business customers. You should retain such documents as part of your duty of care records.

9.4 You acknowledge your legal duty of care in respect of waste. By using our services, you agree to provide accurate information about the type and origin of the waste and to co-operate with us in fulfilling regulatory obligations.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill when providing our services. However, you acknowledge that rubbish clearance and waste collection may involve manual handling, movement of bulky items and the use of vehicles in close proximity to property.

10.2 We will not be liable for any damage to property or belongings where such damage results from:

a. Pre-existing defects, instability or poor condition of structures, surfaces or items.

b. Inadequate or misleading information about access, weight limits or the condition of items to be removed.

c. Reasonable movement of items through tight or restricted spaces where you have requested that collection proceed.

10.3 You are responsible for protecting floors, walls, fixtures, and fittings where you are concerned about potential scuffs or damage from removal activities. We will take reasonable care but cannot guarantee that all risk of minor damage can be eliminated.

10.4 Our total liability to you in respect of any loss or damage arising out of or in connection with the services, whether in contract, tort or otherwise, shall not exceed the total price paid or payable for the specific service giving rise to the claim, except where such limitation is not permitted by law.

10.5 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded.

11. Insurance

11.1 We maintain appropriate public liability insurance in connection with the provision of our services.

11.2 Details of our insurance cover can be made available on request. You remain responsible for arranging any additional insurance you consider necessary.

12. Complaints and Disputes

12.1 If you have a concern or complaint about our service, you should contact us as soon as possible so that we can try to resolve the matter informally.

12.2 You should provide full details of the issue, including dates, the service address, and any relevant photographs or evidence.

12.3 We will investigate your complaint and respond within a reasonable timeframe. Where appropriate, we may offer a remedy such as a partial refund, re-attendance, or other corrective action.

12.4 If a dispute cannot be resolved informally, either party may pursue their rights through the courts or applicable dispute resolution procedures.

13. Privacy and Data Protection

13.1 We collect and process personal data for the purposes of handling enquiries, managing bookings, providing services, processing payments, and complying with our legal obligations.

13.2 We will handle your personal information in accordance with applicable data protection laws. We will not sell your data to third parties. We may share data with trusted partners where necessary to deliver services or meet legal requirements.

13.3 You have rights in relation to your personal data, including the right to access certain information we hold about you. You can contact us for further details.

14. Health and Safety

14.1 We take health and safety seriously and will take reasonable steps to protect our staff, customers and the public during the provision of services.

14.2 We may refuse to carry out or continue any work that, in our reasonable opinion, presents an unacceptable risk to health and safety. This may include unsafe structures, aggressive behaviour, or hazardous materials.

14.3 You agree to co-operate with us in maintaining a safe working environment, including keeping pets and children away from the immediate work area during clearance activities.

15. Force Majeure

15.1 We will not be liable for any delay or failure to perform our obligations where such delay or failure results from events or circumstances beyond our reasonable control, including but not limited to severe weather, accidents, road closures, strikes, equipment failure, or acts of government.

15.2 Where a force majeure event occurs, we will endeavour to notify you and to re-arrange the service as soon as reasonably practicable.

16. Changes to These Terms

16.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or communicated to you.

16.2 The terms applicable to your booking are those in force at the time you place your order, unless a change is required by law or regulatory authority.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services we provide, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

18. Severability

18.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

19. Entire Agreement

19.1 These Terms and Conditions, together with any written service confirmation or invoice provided to you, constitute the entire agreement between you and us in relation to the services and supersede any prior understandings, agreements or representations.

19.2 No variation of these terms shall be effective unless agreed in writing by us.
